1. COPYRIGHT
All images are protected by copyright. Michael Drescher always remains the sole author – even for paid assignments. Transfer of authorship is excluded.
2. USAGE RIGHTS
Upon delivery of the images, clients are granted simple private usage rights, unless otherwise agreed:
- Use on social media, private prints (e.g. posters, calendars, personal use)
- No sharing with third parties without written consent
- No editing, filters, cropping, or manipulation of the images
- Photo credit “MICHAEL DRESCHER PHOTOGRAPHY” is strongly recommended
- Mandatory for all public use (e.g. social media) – including tagging and linking
- No use in ads, flyers, websites, posters etc. without written agreement
→ In case of violation: a written warning will be issued. If there is no response
within 7 days, a flat contractual penalty of 80% of the regular image price per
case applies.

3. COMMERCIAL USE
All commercial or business-related use requires a separate written license and is subject to fees:
- Examples: companies, event hosts, tuning platforms, sponsors, shops, magazines, press
- Unauthorized use will be backcharged according to the official MFM table + 100% contractual penalty
- Legal action will be taken in the event of misuse or copyright violation
4. IMAGE SELECTION & EDITING
- Image editing is carried out according to the artistic discretion of Michael Drescher
- RAW files will not be provided
- For events, only a curated selection of images is delivered that meets quality standards
5. IMAGE PUBLICATION BY THE PHOTOGRAPHER
Michael Drescher reserves the right to use all resulting images for his own promotion (website, Instagram, brochures, etc.)
If not desired, this must be communicated in writing before the shoot.

6. DOWNLOADS & WEB GALLERIES
- Web galleries are limited to 72 dpi and watermarked – not suitable for printing
- High-resolution images are delivered with multiple watermarks
- Unmarked image files only available at extra cost
- Removing or covering the watermark is strictly prohibited

7. LIABILITY
- No liability in cases of force majeure (e.g. weather, technical failure, illness)
- No guarantee for specific image quantities at non-commissioned events

8. PAYMENT TERMS
-All services are invoiced. According to § 19 UStG (small business regulation), no VAT is shown

9. PLACE OF JURISDICTION
Jurisdiction: the photographer’s place of residence.

10. PROTECTION OF INTELLECTUAL PROPERTY
All content, structure, pricing, and visual identity of “Michael Drescher Photography” are protected intellectual property.
Any deliberate imitation, duplication, or offering of similar packages under comparable terms may be considered unfair competition and legally prosecuted.
This also applies to the structure of social media formats (e.g. story series with logo, event info, image sequences, links, and CTAs) that are part of the brand communication of Michael Drescher Photography.
